Vietnam issues new decrees on data regulation and labor penalties

The Vietnamese government has issued new decrees establishing administrative penalties for violations in the data and labor sectors.

Decree 363/2026/NĐ-CP regulates administrative violations in the field of data. It outlines specific penalties, enforcement measures, and remedial actions for various violations. The decree applies to Vietnamese organizations and individuals, as well as foreign entities operating in or related to data activities within Vietnam. It does not cover violations already addressed under cybersecurity and personal data protection regulations.

Additionally, Decree 283/2026/NĐ-CP, effective September 10, 2026, introduces penalties regarding labor, social insurance, and overseas contract work. Notably, Article 17 stipulates fines between 15 million and 30 million VND for sexual harassment in the workplace that does not reach the threshold for criminal prosecution. The regulation defines the workplace broadly and covers physical, verbal, and non-verbal forms of harassment, including those occurring through electronic means.
