Vietnam issues regulations for data exchange platform trading

The Vietnamese government has issued Decree 314/2026/ND-CP, establishing regulations for the operation of data exchange platforms. The decree outlines specific requirements for organizations and individuals wishing to participate in data trading.

Vietnamese legal entities must be legally established and operating within the country, and must not be undergoing processes such as division, merger, dissolution, or bankruptcy. Foreign legal entities must be legally established in their home jurisdiction, comply with civil law requirements, and maintain a commercial presence, branch, or representative office in Vietnam.

Individuals participating in transactions must possess full civil capacity. Furthermore, organizations providing data products or services categorized under conditional business lines must obtain a business eligibility certificate. The decree also mandates that all traded data and services must have legal origins and be supported by valid documentation regarding their collection or transfer.
