Vietnam Land Authority addresses land certificate revocation dispute
The Ministry of Natural Resources and Environment has provided guidance regarding a dispute over the revocation of a land use rights certificate in Vietnam. The case involves a 194 square meter plot of land originally granted to a family member, which was later subject to a revocation decision by local authorities in February 2026 on the grounds that it was issued to the wrong subject.
The family involved has maintained continuous use and tax payments for the land since 2000 without dispute. Following the revocation, the original owner sought clarification on the legal basis for re-issuing a certificate for the current land area.
The Ministry stated that because this is a specific local matter, the resolution must be based on local archives, the legal status of the land, and specific local implementations of the Land Law. However, the Ministry noted that under Article 152 of the 2024 Land Law, certificates may be corrected, revoked, or canceled if they are issued by incorrect authority, to the wrong subject, or with incorrect area details.
