Vietnam National Assembly issues Resolution 37/2026/QH16 on economic and tech violations

The National Assembly of Vietnam has issued Resolution No. 37/2026/QH16, establishing specific mechanisms and policies for handling legal violations related to the state and private economies, as well as scientific, technological, and digital transformation initiatives.

Under Article 5, prosecution may be waived if certain conditions are met: the actions involved no corruption, were performed for the public interest, and the investments or innovations resulted in socio-economic benefits for the country. Additionally, there must be no unresolved complaints or denunciations, and no loss or waste of assets, or all damages must have been fully remediated.

Regarding sentencing, Article 10 provides for the postponement, suspension, reduction, or exemption of prison sentences for those who meet specific criteria. If a court has issued a sentence but execution has not yet begun, the sentence may be postponed for up to two years. If all damages are fully remediated during this period, the sentence may be exempted. For those currently serving sentences, if they meet the requirements of the resolution, they may be exempted from the remaining portion of their prison term.
