Vietnam pilots civil litigation to protect social insurance rights

Vietnam is implementing new legal mechanisms to protect workers' rights against companies that delay or evade social, health, and unemployment insurance contributions. Following Resolution No. 205/2025/QH15 of the National Assembly, the People's Procuracy is piloting civil litigation to protect the interests of vulnerable groups and the public interest.

Under this mechanism, social insurance agencies will review and classify violating entities, providing necessary documentation to the People's Procuracy. If companies fail to rectify violations after being prompted, the Procuracy can initiate lawsuits to recover unpaid funds. This approach shifts the response from mere inspection and urging to active legal enforcement to ensure the legitimate rights of employees are upheld.
