Vietnam proposes higher fines and stricter enforcement for legal violations

Vietnam is considering significant amendments to its legal frameworks regarding food safety and the handling of administrative violations.

The Ministry of Health has proposed a draft amendment to the Law on Food Safety, which includes enhanced post-inspection measures such as sampling, testing, and market surveillance. Under this proposal, authorities could seal non-compliant food products and suspend the sale or advertising of violations. Organizations found violating food safety regulations could face fines of up to 3 billion VND.

Simultaneously, a draft amendment to the Law on Handling Administrative Violations proposes stricter enforcement measures. These include the ability to suspend exit permits for individuals or legal representatives who have not complied with penalties. Additionally, authorities may propose cutting off electricity, water, or internet services to facilities subject to certain administrative sanctions. The draft also suggests increasing maximum fines to 1.5 billion VND for individuals and 3 billion VND for organizations.
