Vietnam proposes legal protection for proactive officials

The National Assembly Standing Committee met on August 17 to discuss a draft resolution regarding special mechanisms and policies for handling legal violations related to the state economy, private economy, science, technology, innovation, and digital transformation.

Minister of Public Security, General Luong Tam Quang, presented a report on the draft, which aims to provide a legal basis to protect officials who are proactive, creative, and act for the common good without engaging in corruption, waste, or negativity. The draft maintains a structure of three chapters and 13 articles, with 11 articles having been revised following feedback from delegates.

Key adjustments include removing the mandatory requirement that a violator must have clearly disclosed the facts and contributed effectively to crime detection as a prerequisite for non-prosecution. This change ensures consistency with existing policies regarding land law violations. Additionally, the draft has been refined to avoid creating new procedures for reviewing finalized judicial decisions or disciplinary actions.
