Vietnam proposes stricter conditions for adoption in new draft law
The Vietnamese Ministry of Justice has presented a draft of the amended Law on Adoption to the National Assembly. The proposed changes aim to strengthen child protection, improve administrative procedures through digital transformation, and align with international treaties.
Key provisions include stricter eligibility for adoptees, limiting adoption to abandoned or orphaned children to ensure they are not unnecessarily separated from their biological families. For prospective adopters, the draft introduces new prohibitions. It seeks to bar individuals currently under criminal prosecution, those serving non-custodial reform, those on conditional early release, or those serving suspended prison sentences from adopting.
Furthermore, the government proposes that individuals convicted of specific crimes—including those against human life, health, dignity, or involving drug offenses and human trafficking—remain ineligible for adoption even after their criminal records have been expunged. The draft also introduces the involvement of social workers to support and monitor the adoption process to ensure a safe and healthy environment for children.
