Vietnam seeks clearer real estate market regulation mechanisms
Proposed amendments to the Law on Real Estate Business in Vietnam aim to create more flexible management tools to proactively respond to market fluctuations. However, experts suggest that the draft law lacks clarity regarding the specific criteria used to identify market conditions that require intervention.
Currently, regulations allow for market regulation when real estate developments are “complex” and affect socio-economic stability. The Vietnam Institute for Real Estate Market Assessment has noted that the draft does not define what constitutes “complex developments” or specify which authority is responsible for making such assessments.
To prevent inconsistent application and protect the rights of investors and citizens, experts recommend quantifying indicators such as price fluctuations, liquidity, transaction volume, supply levels, real estate credit, and supply-demand imbalances. Clearer principles are also needed to determine the scope and conditions for applying different regulatory measures.
