Vitória to seize abandoned properties for social housing
The city of Vitória has implemented Decree No. 27.034, regulating the Central Area Rehabilitation Program (ReAC). This legislation allows the municipal government to seize abandoned houses, buildings, and land in the city's central district to promote urban occupation and new housing projects.
Under the new rules, the government can assume control of properties that are unused, deteriorated, and where owners show no interest in recovery. Once incorporated into the municipal heritage, these spaces may be repurposed for social housing, converted into apartments, or used for public services and equipment.
The process is not automatic. The City Hall must prove abandonment by identifying signs such as accumulated trash, structural damage, lack of maintenance, or ignored notifications. Additionally, property tax (IPTU) debts spanning at least five years may serve as further evidence. Before seizure, an administrative process is opened to allow owners 30 days to present a defense or demonstrate intent to recover the property.
