Vladimir Cerrón Remains in Preventive Detention as Court Clarifies Ruling

Peruvian judge Leodán Cristóbal Ayala ruled that two later judicial resolutions—one dated 4 December 2025 and another dated 7 January 2026—still support the preventive detention and police orders against Vladimir Cerrón, the leader of Peru Libre. Because the Constitutional Court’s (TC) July 2026 decision annulled only earlier rulings and did not address these two later decisions, the judge deemed the TC’s order "materially unenforceable" and referred the matter back to the TC for clarification.

The Sixth National Investigative Preparation Court therefore will not execute the TC’s order to lift Cerrón’s 24‑month preventive detention related to alleged illegal financing of Peru Libre’s electoral campaigns until the Constitutional Court responds. The case underscores a legal impasse over whether the TC’s judgment extends to subsequent rulings that remain in force.
