Georgia social media age verification law upheld by appeals court
The U.S. Court of Appeals for the 11th Circuit has ruled that Georgia may enforce the Protecting Georgia’s Children on Social Media Act. This law requires social media platforms to verify the age of account holders and restricts use by minors under 16 without parental or guardian permission. Additionally, the legislation limits advertising and data collection regarding minors.
The law was challenged by NetChoice, a trade association representing companies such as Meta, Google, Amazon, and eBay. NetChoice filed a lawsuit against Georgia Attorney General Chris Carr in 2025, arguing that the mandate violates the First Amendment by chilling the rights of Georgians to engage in anonymous online speech.
