A lawsuit has been filed against Walt Disney World Resort following an injury to a guest at Magic Kingdom Park. Deborah Montgomery, who suffers from chronic arthritis, was using a rented electric convenience vehicle (ECV) to navigate the queue for the Under the Sea – Journey of The Little Mermaid attraction on August 7, 2024.

The legal filing alleges that while navigating a slope in the cave-like queue, Montgomery’s foot became wedged in a narrowing crevice along the wall. As the ECV continued moving forward, she sustained injuries to her foot, ankle, and leg, including a fractured fibula and what the suit describes as permanent shock to her nervous system.

The plaintiffs, which includes Deborah’s husband Matthew Montgomery, are seeking $50,000 in damages. The lawsuit contends that Disney failed to provide a safe pathway, adequate lighting, sufficient warning signs, or proper inspections of the queue area.
