Warsaw prosecutors dismiss investigation into alleged coup d'état

The District Prosecutor's Office in Warsaw has dismissed the investigation into the so-called ‘coup d’état’ regarding the Constitutional Tribunal, the Supreme Court, and the National Council of the Judiciary. This decision marks the conclusion of the final of six main threads in the case.

Prosecutor Piotr Antoni Skiba stated that the actions described in the investigation did not meet the criteria for criminal offenses. The prosecution noted that it is not the role of a prosecutor to resolve the ongoing constitutional debate or to assess the legal status of judges or the validity of decisions issued by these institutions.

The investigation concluded that even if certain political groups aim to change the state system, such actions—when conducted without violence—fall within the constitutional rights of citizens and political organizations. The prosecutor highlighted that the events occurred during an unprecedented constitutional dispute regarding the legality of judicial appointments made after 2015 and 2017. The decision is not yet final, and affected parties have the right to appeal.
