Western Australia proposes major anti-discrimination law reforms

The Western Australian government has introduced the Equal Opportunity Bill 2026, a significant overhaul of the state’s anti-discrimination laws intended to replace the Equal Opportunity Act 1984. The proposed legislation aims to strengthen protections for LGBTQ+ individuals, specifically prohibiting religious schools from dismissing teachers or expelling students based on their sexual orientation.

Attorney-General Dr. Tony Buti clarified that while religious institutions will retain exemptions regarding religious beliefs, they will no longer be permitted to discriminate based on sexual orientation. The bill also introduces new protections against vilification related to disability, race, religion, sexual orientation, gender identity, and sex.

Beyond LGBTQ+ protections, the reforms seek to outlaw discrimination against people experiencing homelessness, domestic violence, pregnancy, breastfeeding, or involvement in union activities. The legislation also expands protections regarding disabilities in various settings, including schools. Premier Roger Cook stated the reforms aim to ensure that discrimination and abuse based on race, religion, sexuality, or disability are not tolerated in the state.
