YAPI maintains land claim for MTs Islam Pati despite court ruling
The Yayasan Perguruan Islam Pati (YAPI) is maintaining its claim over land currently used by MTs Islam Pati, asserting that it holds the original Land Ownership Certificate (SHM) Number 1201 issued in 1992.
YAPI legal counsel Ahmad Triswadi stated that a recent ruling by the Semarang State Administrative Court (PTUN) does not resolve the core dispute regarding land ownership. The court ruled it lacked jurisdiction over the matter, stating that disputes involving wakaf (endowment) fall under the absolute authority of the Religious Court.
The legal conflict specifically involves the issuance of Nazhir (endowment manager) registration documents by the Pati Regency branch of the Indonesian Waqf Board (BWI). YAPI argues that the dispute concerns administrative decisions made by the BWI, which should fall under the PTUN's jurisdiction, rather than the underlying land ownership. The dispute arose after the BWI issued management documents to the Wahid Hasyim Foundation for the same land object previously managed by YAPI.
