Yargıtay rules verbal insults are grounds for divorce and compensation
The Turkish Court of Cassation (Yargıtay) 2nd Civil Chamber has issued a precedent-setting ruling regarding verbal insults in divorce proceedings. The case involved a young couple undergoing a divorce due to severe incompatibility.
Following a lower court's decision that found both parties equally at fault, the Court of Cassation overturned the ruling. The high court emphasized that the husband's repeated use of the terms ‘eşeksin, hayvansın’ (you are a donkey, you are an animal) constituted an attack on the wife's personality rights.
The court noted that while the wife had committed a single act of physical violence, the husband's behavior—which included daily alcohol consumption and continuous verbal insults—was more severe and persistent. Consequently, the court ruled that the husband bore greater fault, granting the wife the right to seek material compensation.
