Yargıtay rules neglect of marital duties is grounds for divorce fault
The Turkish Court of Cassation (Yargıtay) has issued a precedent-setting ruling regarding divorce cases and the assignment of fault. In a case originating from Bursa, the 2nd Civil Chamber overturned a lower court decision that had previously found the husband solely at fault for the breakdown of the marriage.
Based on witness testimonies, the high court determined that the wife was also at fault due to her continuous insults and humiliation toward her husband, as well as her neglect of marital duties, specifically by being frequently absent from the home and failing to prepare meals. While the Turkish Civil Code does not list ‘not cooking’ as a direct cause for divorce, the court ruled that these actions contributed to the fundamental breakdown of the marriage union, justifying the husband's request for divorce.
