Yoshinori Kobayashi sues Japanese government over Imperial House Law
Manga artist Yoshinori Kobayashi has filed a lawsuit in the Tokyo District Court seeking to invalidate the recently amended Imperial House Law and requesting damages. The lawsuit claims the amendment violates Article 14 of the Japanese Constitution, which guarantees equality under the law by prohibiting discrimination based on lineage.
The amendment, which went into effect on October 24, aims to ensure the number of Imperial family members by allowing the Imperial House to adopt male descendants from former collateral branches (kyu-miyake) who left the Imperial family in 1947. The new system specifically targets male descendants aged 15 or older who do not have a spouse or children.
Kobayashi argues that restricting the path to becoming a member of the Imperial family to specific bloodlines constitutes discrimination based on lineage. The legal challenge raises fundamental questions regarding the compatibility of the hereditary Imperial system with constitutional principles of equality.
