YouTube requires judicial authorization for videos featuring minors in Brazil

YouTube has announced new content policies in Brazil requiring channel owners to obtain judicial authorization from the Court of Childhood and Youth (Vara da Infância e da Juventude) for videos featuring children and adolescents. This change, communicated to creators in late October, takes effect in November.

The measure is an adaptation to the Digital Statute of the Child and Adolescent (ECA Digital), also known as the Felca Law. This legislation aims to protect minors in digital environments by replacing self-declaration of age with reliable verification mechanisms and prohibiting the monetization or promotion of content that exposes or eroticizes minors.

Failure to comply with these rules may result in video demonetization, channel deletion for repeat offenders, or legal sanctions. Under Brazilian law, companies violating these regulations face penalties including warnings, fines of up to 10% of their Brazilian revenue (capped at R$ 50 million), and the potential suspension or prohibition of their activities.
