Yozgat court halts removal of school assistant principal

The Yozgat Administrative Court has issued a stay of execution regarding the removal of a school assistant principal in the Saraykent district. The decision follows a lawsuit filed by the Education and Science Power Solidarity Union (Eğitim Gücü Sen) on behalf of a union member.

The teacher had begun their four-year term as assistant principal on July 30, 2024, which was scheduled to conclude in July 2028. However, the individual was reassigned to a teaching position before the term ended due to the removal of the assistant principal position from the official norm cadre.

In its ruling, the court found the administrative action unlawful, noting that transitional provisions exist to protect the terms of current administrators even when titles are removed from legislation. The court emphasized the principles of legal certainty, the protection of existing rights, and the continuity of public service, stating that continuing the reassignment could cause irreparable harm to the individual's professional life.
