A445 motorway construction legal dispute
Overview
The construction of the A445 motorway in North Rhine-Westphalia, intended to connect the A2 and A44 motorways to relieve traffic on Bundesstraße 63, underwent legal scrutiny by the Federal Administrative Court (Bundesverwaltungsgericht).
Initial legal challenges were brought by a local resident and the North Rhine-Westphalia State Association for Nature and Environmental Protection. The plaintiffs alleged that the eight-kilometer project violated various regulations, including water, species protection, climate protection, and noise protection laws. A specific point of contention involved the planned diversion of the Bewerbach stream.
On October 7, the court dismissed the lawsuits, ruling that the planning approval did not contain errors regarding water law, species protection, or climate protection. The court found that the relocation of the Bewerbach stream would not violate the European Water Framework Directive and determined that noise protection measures for the private resident had been appropriately addressed, allowing the project to proceed.
