AfCFTA operational implementation and harmonization

The African Continental Free Trade Area (AfCFTA) is transitioning from a political agreement into a complex operational phase. While the agreement began operating in January 2021, significant hurdles remain in creating a unified market, including inconsistent national customs systems, unfinished legal frameworks, and incompatible payment networks. Currently, the arrangement functions as a free-trade area rather than a full customs union, as national governments maintain individual commercial laws.

As implementation moves toward practical procedures, African leaders are emphasizing the necessity of regulatory harmonization. During the 32nd African Organization for Standardization (ARSO) General Assembly, Deputy President Kithure Kindiki warned that “fifty-four separate regulatory silos” prevent the AfCFTA from functioning as a single market. He noted that differing national requirements increase costs and complexity, as products often require repeated testing and inspection when crossing borders.

While nearly all 55 African Union member states have signed the agreement and 49 have ratified it, the focus is shifting toward establishing common standards and certification systems. Some progress has been noted in specific sectors, such as the automotive industry, which established rules of origin in early 2026 to facilitate duty-free trade.
