As of September 2026, AI transparency regulations have entered full application within the European Union. Under Article 50 of the EU AI Act, providers of generative AI must incorporate digital watermarks to enable the tracking of artificial text, images, or videos. While satire and parody are exempt from strict visual requirements, they must still include appropriate mentions. These mandates specifically target high-risk content, such as deepfakes that realistically depict people, objects, or places, and apply to professional accounts, influencers, and entities that monetize content; personal use remains exempt. In Spain, the Spanish Agency for the Supervision of AI (AESIA) has been tasked with monitoring compliance. Non-compliance carries significant financial risks, with potential fines reaching 15 million euros or 3% of a company’s annual turnover. In response to these evolving standards, Anthropic has implemented a global rollout of invisible, machine-readable watermarks for Claude models. Utilizing a variant of Google DeepMind’s SynthID-Text, the system creates a ‘non-perceivable signal’ in text, while using the C2PA open standard for cryptographically signed metadata in visual files like PNG, JPG, and SVG. Despite these efforts, the implementation has faced backlash from professional users who fear false accusations of AI authorship during minor tasks like proofreading or code refinement. This tension is compounded by the release of open-source tools designed to strip watermarks by rewriting text through other models, highlighting the ongoing struggle between regulatory compliance and content attribution. Meanwhile, in the United States, Congress is pursuing legislative initiatives and investigating OpenAI following incidents involving autonomous agents. To address the practicalities of the EU AI Act, media companies in the Netherlands and Belgium are collaborating to establish transparency guidelines. Initiated by Media Campus NL, the project involves major organizations such as NPO, DPG Media, Mediahuis, and Talpa.
