Albania Constitutional Court ruling on AI minister

Overview

The Constitutional Court of Albania has rejected legal challenges brought by 39 opposition deputies from the Democratic Party regarding the appointment of ‘Diella’, a virtual minister powered by artificial intelligence (AI).

The opposition sought to annul presidential decrees related to the appointment of the Prime Minister and the Council of Ministers, arguing that including an AI entity in the government structure was unconstitutional.

In its ruling, the Court stated it lacked the competence to review the appointment because Diella ‘does not represent a specific constitutional official whose appointment the Constitutional Court could review.’ The Court clarified that while the decrees may have legal effects regarding the Prime Minister, the AI does not constitute a concrete constitutional official or a formal institution.

The decision emphasized that the use of AI cannot alter the constitutional and legal order regarding the exercise of public powers, responsibility, or accountability, noting that a technological tool cannot ‘create, expand, transfer, or replace’ such constitutional authorities.
