Arequipa land use regulation dispute

Overview

The Municipal Institute of Planning of Arequipa (IMPLA) has proposed modifying or repealing Regional Ordinance No. 007-2003-GRA/CR, a regulation from 2003 that designates the region’s green areas and agricultural lands as intangible.

IMPLA manager Patricia Muñoz Medina stated the change is a “technical necessity” to align urban planning with the Law of Sustainable Urban Development and to facilitate the implementation of the Metropolitan Development Plan (PDM) 2026. She argued that the existing ordinance interferes with provincial municipal competencies and requires updating to rectify technical errors.

Following this proposal, the Arequipa Regional Council has expressed skepticism. Legal advisors for the Regional Government issued an unfavorable opinion, emphasizing the need to preserve significant agricultural spaces in districts including Cayma, Sabandía, and Socabaya. The proposal is currently under evaluation by various commissions, such as the Ecology and Territorial Conditioning commission, to determine if the municipal request is technically sufficient.
