Argentina expands security and detention reforms

In late July 2026 the Argentine government issued two separate legal adjustments that broaden the state’s ability to intervene in security matters. On 27 July, Law No. 27 785 added a "reiterancy" provision to the Penal Code and the Federal Criminal Procedure Code, allowing judges and prosecutors to consider multiple open cases against the same suspect when deciding on preventive detention. The change is framed as a tool to improve risk assessment while preserving the presumption of innocence, and it distinguishes reiterancy from recidivism, which requires a prior conviction.

Two days later, on 29 July, the Ministry of Security released Resolution 725/2026, revising police protocols for monitoring cyber‑threats in schools. The new rules prohibit the processing of minors' sensitive data and online posts without a judicial order, except when an imminent serious threat—such as kidnapping, self‑harm, or mass violence—is identified. The amendment aims to enhance coordination between police and the judiciary, accelerate preventive actions, and protect students’ privacy amid a rise in intimidation messages on social media.

Together, these measures reflect a broader push by Argentine authorities to tighten security‑related legislation while attempting to balance civil‑rights safeguards.
