The Fundación Soberanía has filed a judicial complaint in Argentina seeking to investigate and potentially annul the privatization of hydroelectric dams within the Complejo Comahue. The complaint alleges a “chain of illegalities” involving the systematic undervaluation of state assets to benefit specific companies, such as the Neuss Group, BML Inversora S.A.U., and Central Puerto S.A. A central allegation is that the government bypassed the National Valuation Tribunal (TTN) by failing to allow for specialized assessments, instead utilizing the Banco de Inversión y Comercio Exterior (BICE) to facilitate valuations. This maneuver is described in the legal filing as a “preconstitution of a cause of temporal impossibility.” The investigation is currently being handled by the Federal Court of General Roca.
