The Supreme Court of Argentina has overturned the acquittal of former Army Chief César Milani in a case involving the 1976 disappearance of conscript Agapito Ledo. By majority decision, the court accepted arguments from the Attorney General's Office, which challenged previous rulings that had acquitted Milani based on the benefit of the doubt. The high court found that lower tribunals failed to exhaustively evaluate evidence regarding whether Milani knew or had reason to believe Ledo was a victim of a crime rather than a deserter. The ruling also noted discrepancies regarding Milani's claims that the soldier had taken his own belongings. Following these findings, the court has ordered the case to be returned to the Federal Chamber of Criminal Cassation for a new ruling to be conducted by a different panel of judges. The prosecution, represented by interim Attorney General Eduardo Casal, argued that previous acquittals were insufficiently founded and that Milani may have covered up Ledo's illegal detention by falsely documenting it as a desertion. In a dissenting opinion, judge Carlos Rosenkrantz argued that the acquittal should have been upheld, maintaining that the specific participation of each defendant must be proven beyond a reasonable doubt.
