Judicial rulings in Argentina have increasingly recognized the legal status of animals as sentient beings. In Rawson, Chubut, Criminal Judge Eve Ponce ruled that 23 animals rescued from a farm characterized by overcrowding and neglect are sentient beings entitled to legal protections. The court ordered that these animals remain permanently with the families who assumed responsible ownership of them. Following this, Federal Judge Federico Calvete issued a ruling regarding a dispute over rabbit population control at the Center for Advanced Studies in Tierra del Fuego (CADIC). Although the specific case was declared abstract because the disputed control methods were not implemented, Calvete asserted that animals are sentient beings and should be considered ‘non-human subjects of rights’ possessing ‘fundamental rights.’ In a landmark ruling in Ushuaia, Judge Calvete further recognized European rabbits as subjects of rights. The decision originated from a 2020 legal battle intended to prevent CADIC-CONICET from using toxic phosphine gas to manage a rabbit colony that was nesting under building foundations. While the lawsuit was declared moot after the planned poisoning procedure was suspended, the court established a significant precedent. The ruling, supported by organizations such as Amigos del Reino Animal Fueguino (ARAF) and the Asociación de Funcionarios y Abogados por los Derechos de los Animales (AFADA), reinforces the legal standing of animals as non-human subjects of rights.
