Argentine labor court severance rulings
Overview
Argentine labor courts have issued significant rulings regarding the calculation of severance payments under modern legal frameworks.
In San Juan, a labor court applied Article 55 of Law 27.802, known as the Labor Reform, to a 2014 dismissal case. This decision increased a severance payout from approximately 5.8 million pesos to 158 million pesos, as judges determined the new law is of public order and applies to ongoing legal processes without a final sentence. The companies involved have appealed to the local Court of Justice.
In a separate case in Lomas de Zamora, judges reduced a severance payment to prevent a “patrimonial collapse” for a small security company. In that instance, a 2019 claim had escalated to 46.6 million pesos due to automatic indexation mechanisms. The court utilized provincial Supreme Court precedents to adjust the figures after noting that the application of modernization laws had multiplied the original capital 57 times.
