The Arizona Court of Appeals has vacated the 10-year manslaughter sentence of Gabriel Paul Horcasitas, ordering a resentencing due to the improper use of an AI-generated video during his initial punishment hearing. The video, created by the sister of victim Christopher Pelkey, Stacey Wales, used the deceased’s likeness and voice to depict him offering forgiveness to Horcasitas. While the presiding judge, Todd Lang, had previously described the video as ‘genuine’ and stated he ‘loved’ it, the appellate court ruled its use was a ‘fundamental error’ that prejudiced the sentencing procedure. The court determined the video was an unreliable representation of the victim’s thoughts created from the ‘imaginings of the victim’s sister’ rather than a documentation of real events. The ruling highlights the legal complexities and potential risks of using generative AI and synthetic media within criminal justice proceedings. Although the sentence was overturned to protect due process, Horcasitas’s manslaughter conviction remains intact.
