Austrian climate protection law development

The Austrian government has progressed toward a new climate protection law aimed at achieving climate neutrality by 2040. Following negotiations between the ÖVP, SPÖ, and NEOS, the legislation was formally introduced in September 2026. The law is structured around three pillars: emission reduction, climate change adaptation, and the circular economy.

Environment and Agriculture Minister Norbert Totschnig described the legislation as a framework to secure prosperity and jobs while meeting environmental goals. The law establishes binding annual greenhouse gas emission limits through 2030 and mandates a climate roadmap with specific sector targets—covering transport, buildings, small industry, agriculture, and waste—by the end of 2027. To ensure compliance, a correction mechanism requires the government to propose countermeasures within three months if annual targets are projected to be missed. A scientific climate advisory board will also be established to provide recommendations. The legislation specifically targets sectors not already covered by the European Emissions Trading System (ETS).

As the law enters the review process, experts from the Wegener Center for Climate and Global Change suggest that strong reductions could reduce Austria’s high economic vulnerability. To meet EU 2030 targets, the country must reduce CO2 equivalents by 2.75 million tonnes annually starting in 2027. Climate expert Karl Steininger noted that previous reductions often resulted from external crises rather than proactive policy, emphasizing the need for consistent annual measures.

In parallel, the ‘Lebenswerte Straßen und Plätze’ (Livable Streets and Squares) initiative has been launched to assist municipalities with climate adaptation. This program focuses on the ‘sponge city’ principle to combat heat islands and manage heavy rainfall through greenery and light-colored paving.
