Austrian unemployment benefit miscalculation ruling
Overview
The Austrian Administrative Court (Verwaltungsgerichtshof) ruled that the Public Employment Service (AMS) systematically miscalculated unemployment benefits for low-income earners. The error occurred because the AMS applied standard unemployment insurance contribution rates rather than the reduced or exempted rates to which certain low-income individuals were entitled.
The ruling follows a legal challenge by a woman in Upper Austria who discovered her benefits were calculated incorrectly. Previously, the AMS applied a flat 3 percent unemployment insurance deduction to determine net income. However, the court ruled that the agency must account for income-dependent, tiered insurance premium rates, which are often zero or significantly lower for low-income earners. This error resulted in underestimated net income and, consequently, lower benefit entitlements.
The AMS expects to pay approximately €135 million in backpayments to a six-figure number of individuals. The agency plans to proactively review files covering periods prior to January 1, 2027. To manage the situation, the government is working on a legal basis for repayments and has retroactively suspended statute of limitations periods from September 22, 2026, to prevent claims from expiring during the processing period. Social Minister Korinna Schumann stated that the government is working to ensure a “legally secure solution.”
