Balkan legal scrutiny of nationalist musical content

Overview

Legal authorities in the Balkans have recently examined musical performances for potential criminal violations involving war-related symbolism and hate speech.

In Montenegro, the Basic State Prosecutor’s Office in Bar launched an investigation into a concert by the Serbian choir ‘Fenečki biseri’. The probe seeks to determine if songs containing nationalistic symbolism, such as ‘Đenerale, đenerale’, constitute the glorification of war criminals. Local officials expressed concerns that such performances could threaten multi-ethnic harmony.

In Bosnia and Herzegovina, the Prosecutor’s Office declined to launch a criminal investigation against an individual in Zvornik who played a song containing the lyric “may it happen again” on the anniversary of the Srebrenica genocide. While prosecutors described the content as “undoubtedly extremely offensive, provocative, and socially unacceptable,” they ruled that the act did not meet the legal threshold for inciting hatred or intolerance under the Criminal Code. The individual was instead issued a misdemeanor fine.
