Catalan amnesty, CJEU backs law
Overview
In late June 2026 the Audiencia of Barcelona reopened investigations into the Pegasus spyware case and the Mossos d'Esquadra officers alleged to have helped Carles Puigdemont’s 2024 escape. The Spanish Constitutional Court later upheld the 2024 Catalan independence amnesty law, while the Barcelona Court of Appeal reinstated the Mossos probe. On 13 July 2026 the Court of Justice of the European Union (CJEU) issued two preliminary judgments on the law’s compatibility with EU financial‑interest rules and the anti‑terrorism directive. Advocate General Dean Spielmann’s opinion concluded that the amnesty did not link to the EU budget, breach the terrorism directive or constitute an “auto‑amnesty”. Two days later, on 16 July 2026, the CJEU delivered binding rulings confirming that the organic amnesty law is compatible with EU law, does not affect Union finances and respects the anti‑terrorism framework. The court expressly stated that EU law does not preclude the amnesty and highlighted its purpose of reducing institutional tension and facilitating political reconciliation. The judgments answer questions from the Spanish Court of Auditors on alleged misuse of public funds and from the Audiencia Nacional on terrorism charges, removing the principal legal obstacle to implementation. Spanish leader Salvador Illa called the decision “very good news for Catalonia, Spain and democracy”. The rulings give the government a basis to release or return exiled figures such as Puigdemont and to lift political disqualifications for Oriol Junqueras, Jordi Turull and others, though separate charges like embezzlement remain outside the amnesty’s scope and further national rulings are still required. The CJEU also confirmed that the law covers the twelve members of the Comités de Defensa por la República (CDR) prosecuted for terrorism‑related protest offences.
