Brazil drug trafficking legal and judicial developments

Overview

The Superior Court of Justice (STJ) has established five legal theses to standardize sentencing for drug trafficking. These criteria mandate that the nature and quantity of drugs be evaluated together as an inseparable binomial, primarily during the third stage of sentencing to determine reduction fractions.

In a separate judicial ruling, Minister Maria Marluce Caldas of the STJ annulled a criminal proceeding and ordered the release of an individual in Olímpia. The court ruled that a Military Police search was illegal due to a lack of founded suspicion, rendering the seized cocaine and crack cocaine evidence inadmissible.

Concurrently, the Chamber of Deputies is considering a legislative proposal to increase penalties for drug crimes involving fraud or deception, such as switching luggage tags to implicate innocent persons.
