Since mid-2025, the Lula administration has expanded the use of the Fundo de Garantia do Tempo de Serviço (FGTS) for debt renegotiation, disaster relief, and institutional credit. On August 6, 2026, Law 15.486/2026 was signed, extending the FGTS credit line for philanthropic hospitals and non-profit institutions supporting the SUS until 2030. This reopens the Caixa Hospitais FGTS program, which has R$ 2.11 billion allocated, with R$ 1.58 billion already in the pipeline. Regarding profit distribution, Caixa Econômica Federal is distributing R$ 13.04 billion in 2025 profits to approximately 138.2 million workers who held balances on December 31, 2025. This distribution, based on an index of 0.01868341, brings the total FGTS account return to 6.9%, exceeding the 2025 inflation rate of 4.26%. Systemic issues regarding unpaid deposits have intensified. To address natural disasters, Caixa has enabled the ‘Saque Calamidade’ modality, allowing eligible residents in disaster-affected municipalities—including parts of Rio Grande do Sul, Pará, Amapá, Pernambuco, and Pernambuco—to Amazonas—to withdraw up to R$ 6,220. In Amazonas, residents of Manaquiri, Uarini, Borba, and Careiro are eligible, with specific request deadlines extending into November 2026. Legally, the Superior Labor Court (TST) established new rules under ‘Tema 32’: cases where withdrawals are linked to employment termination must be judged by Labor Courts, while requests based on factors unrelated to the employment bond, such as serious illness, retirement, or housing, fall under the common justice system. Additionally, the Supreme Federal Court (STF) maintains a five-year statute of limitations for claiming unmade deposits.
