Brazil FIES debt discount legal dispute
Overview
The First Chamber of Brazil’s Superior Tribunal de Justiça (STJ) has taken up special appeals to resolve the specific deadline for granting a 1% discount on Fundo de Financiamento Estudantil (FIES) debt balances. This discount is intended for health professionals who worked within the Sistema Único de Saúde (SUS) during the COVID-19 pandemic.
The court is tasked with determining whether the eligibility deadline is 31 December 2020, marking the end of the public calamity decree, or 22 May 2022, when the Ministry of Health declared the end of the national health emergency. To ensure a standardized interpretation and provide legal certainty, the STJ has suspended all pending cases regarding this issue, noting that over 11,000 processes involving FIES contracts are currently pending nationwide.
