Brazil low-voltage energy market regulation

Overview

The Brazilian federal government issued Decree No. 13.097/2026 to regulate the migration of low-voltage consumers into the free electricity market. Under this decree, the National Electric Energy Agency (Aneel) is responsible for establishing the technical rules for the transition.

The market opening is scheduled to occur in two phases: small industries and commerce may migrate starting November 25, 2027, followed by all other consumers, including residential households, on November 25, 2028. While the transition allows for the negotiation of energy costs, the decree notes that network fees and mandatory charges remain unchanged. Additionally, consumers who migrate will lose access to the Social Electricity Tariff (Tarifa Social de Energia Elétrica) and must provide one year’s notice to return to the regulated market. The Brazilian Association of Energy Traders (Abraceel) estimates that the full opening of this sector could lead to annual savings of up to R$ 35 billion.
