Brazil STJ rulings on health insurance coverage

Overview

The Superior Tribunal de Justiça (STJ) has issued rulings regarding the obligations of private health insurance providers in Brazil. In a decision by the STJ’s Second Section, the court determined that insurers are not legally or contractually required to cover cannabidiol-based medications for home use unless explicitly stipulated in a contract or established by law.

This ruling reversed a previous decision from the Rio de Janeiro Court of Justice that had ordered an insurer to provide treatment and pay damages to a patient. While the STJ decision establishes a new legal precedent for future cases, it does not mandate the interruption of treatments currently being funded or nullify definitive judicial decisions that have already secured coverage.

Patient advocacy groups, including the Santa Cannabis Association, have raised concerns that the ruling creates financial barriers for patients who rely on these therapies but cannot afford monthly costs that can exceed R$ 1,200.
