The Brazilian Attorney General's Office (AGU) has initiated several legal proceedings targeting different sectors. In one series of actions, the AGU filed lawsuits against fuel distributors and service stations in states including São Paulo and Rio de Janeiro, alleging abusive pricing practices. Seeking R$ 63.8 million in compensation, the AGU cited findings that commercial margins increased significantly without corresponding rises in acquisition costs. Separately, the AGU has utilized the Anti-Faction Law to file civil lawsuits aimed at recovering approximately R$ 190.3 million from members of the Primeiro Comando da Capital (PCC) and Comando Vermelho (CV) criminal organizations. These actions, filed in federal courts across Paraná, São Paulo, and Rio Grande do Sul, target assets linked to cigarette smuggling, pesticide trafficking, and international cocaine trafficking to Europe. Recent legal maneuvers leverage Law 15.358 of 2026, the ‘Anti-Faction Law,’ which permits the civil forfeiture of illicit assets without a prior criminal conviction. This strategy seeks to dismantle financial structures by targeting primary offenders, financiers, shell companies, and third parties. Four specific lawsuits involve 87 defendants stemming from Operations Marola, Delivery, Contaminatus, and Hinterland. Identified assets include luxury vehicles, aircraft, precious stones, and various companies. Recovered funds are intended for the National Public Security Fund and state security funds.
