The São Paulo Court of Justice has issued separate rulings regarding discriminatory social media content. In one case, former RedeTV! owner Marcelo de Carvalho was ordered to pay R$ 100,000 in collective moral damages following a post that linked European crime to African and Muslim immigration. The court also mandated a public retraction. In a second case, sports commentator Sérgio Maurício was ordered to pay R$ 10,000 in moral damages to Federal Deputy Erika Hilton for transfobic attacks made on social media. The court ruled that Maurício used the deputy’s gender identity to ridicule her. her, specifically referring to her as “a human fake news” and “this thing” in a post on X. Judge Fabio Coimbra Junqueira noted that while freedom of expression is a constitutional right, it does not permit the degradation of individuals. The court highlighted that the post reached approximately 1.8 million views, amplifying the damage to the deputy’s image. In addition to the fine, the sentence requires Maurício to publish a retraction on X or Instagram within 15 days. Failure to comply will result in a daily fine of R$ 500, capped at R$ 15,000. The court deemed a previous apology issued by Maurício in a magazine column insufficient to repair the damage to Hilton’s honor. Following the controversy, Maurício was temporarily suspended from Formula 1 broadcasts and later resigned his contract with Grupo Bandeirantes. The Federal Police are reportedly investigating the matter for potential criminal implications.
