The new regulations reduce bureaucratic requirements by allowing owners to use a Property Aptitude Report instead of a Certificate of Property Adequacy, potentially allowing for a suspension of tax payments for up to three years. On a national level, the Brazilian Supreme Federal Court (STF) has issued a unanimous ruling prohibiting municipalities from setting IPTU rates based solely on a property’s physical area. Arising from a legal challenge to a 2018 law in Chapecó, Santa Catarina, the Catarina—which applied a higher rate to properties exceeding 400 square meters—the court determined that tax progressivity must be based on factors such as value, location, or use. Under Theme 1.455 of general repercussion, this interpretation must be followed by all judicial instances nationwide. Justice Dias Toffoli, the rapporteur, noted that while the Constitution permits rate variations based on use and location, property area is not a valid size can influence market value, it cannot be used as an isolated criterion for to increase the tax progressivity rate percentage under current constitutional amendments.
