Brazilian Supreme Court social security and labor rulings
Overview
The Brazilian Supreme Federal Court (STF) has issued significant rulings regarding social security and labor rights. In October 2026, the court ruled 6-5 in ADI 6.309 that the minimum age requirements for special retirement, established by the 2019 Social Security Reform, are unconstitutional. This decision removes age thresholds—previously set at 55, 58, or 60 years depending on exposure duration—for workers exposed to harmful chemical, physical, or biological agents. However, applicants must still prove occupational exposure and satisfy all other social security requirements.
Concurrently, the STF has resumed deliberations on the national nursing wage floor established in 2022. In a virtual plenary expected to conclude by November 3, the court is debating the extent of the federal government’s financial responsibility. Rapporteur Luís Roberto Barroso has proposed using a 40-hour work week as the parameter for full payment and suggested that federal transfers should cover both salary differences and resulting legal charges. He also argued that a formal collective dispute is not required if an agreement cannot be reached through negotiation.
In contrast, Minister Dias Toffoli, supported by Minister Luiz Fux, argues that the Union should only cover the salary difference itself, excluding charges such as FGTS, social security, and hazard pay. Toffoli also maintains that if unions and employers fail to reach an agreement, a collective dispute must be initiated in labor court.
