California Governor Gavin Newsom has vetoed Assembly Bill 713, which aimed to allow undocumented students to hold paid positions at public community colleges and universities. Proponents of the bill, introduced by Assemblymember José Luis Solache, argued it would provide safe, legitimate income for approximately 60,000 students through roles such as research or lab positions, rather than forcing them to work off the books. Newsom rejected the legislation due to concerns regarding the legal theory that a 1986 federal law barring the hiring of unauthorized workers does not apply to state governments. He warned that proceeding with this “novel legal theory” could expose state employees to criminal and civil liability and invite retaliation from the federal government. Newsom noted that the current federal administration has shown a willingness to target public higher education institutions, stating that the legality must be resolved by federal courts first. This marks the second time in three years that Newsom has rejected similar legislation.
