CESTAT tax and excise dispute rulings

Overview

The Customs, Excise and Service Tax Appellate Tribunal (CESTAT) has issued several rulings across different Indian jurisdictions regarding tax liabilities, penalties, and evidentiary standards.

In earlier proceedings, the Chandigarh Bench ruled in favor of Sant Roadlines, determining that while providing trucks on a kilometer basis was taxable, the company held a ‘bona fide belief’ that its services were not taxable, preventing the invocation of the extended period of limitation. Additionally, the Chennai Bench ruled for Royal Enfield, finding that a penalty imposed on a specific demand exceeded the statutory ceiling and was therefore unauthorized.

Subsequent rulings addressed different aspects of tax law. In Kolkata, the Tribunal held that a retracted statement alone was insufficient to prove clandestine clearance of steel ingots, noting a lack of independent evidence such as buyer or transporter statements. In New Delhi, the Tribunal set aside an extended period of limitation and a penalty for Mec Shot Blasting Equipment Private Limited, ruling that the company was entitled to CENVAT credit for service tax paid under the Reverse Charge Mechanism.

More recently, the Kolkata Bench dismissed appeals from the Commissioner of Customs regarding the reclassification of ice-making and ice-cream-making machinery imported by J. B. Pen Mart. The Tribunal ruled the Department’s attempt to increase the assessed value was unsustainable because it failed to issue a speaking order as required by Section 17(5) of the Customs Act, 1962. The Tribunal noted that the importer’s payment of additional duty under protest did not constitute a written acceptance of the reassessment.
