Chihuahua Congress legislative initiatives

Overview

The 68th Legislature of the Chihuahua Congress has approved an initiative to be sent to the Mexican Congress of the Union to reform the Income Tax Law (ISR). The proposal seeks to grant a full tax exemption on resources derived from severance pay, liquidations, and retirement and old-age disability subaccounts.

Jorge Soto Prieto, president of the Commission on Programming, Budget, and Public Finance, stated that the initiative aims to achieve “social and tax justice.” Proponents argue that these funds are intended to guarantee the subsistence of workers who can no longer earn income through active labor due to age or other conditions.

The reform proposes modifying Article 93 of the ISR Law to recognize these payments as fully exempt, treating them as social protection rather than standard income. Legislators, including Deputy Francisco Sánchez Villegas, emphasized that the measure aims to prevent the government from retaining significant portions—up to 35 percent—of these payments, which are intended to provide economic stability during periods of unemployment or retirement.
