The Chilean General Treasury of the Republic (TGR) has reported recovering over US$115 million from delinquent Credit with State Guarantee (CAE) debtors. While more than 62,000 payment agreements have been signed, the TGR noted that some agreements have expired or are subject to active judicial claims. To facilitate recovery, new rules allow for lower initial payments and capped monthly installments, though the TGR has warned of enforcement measures including the garnishment of bank accounts and salary retention. Following collection efforts, the La Serena Court of Appeals issued a ruling regarding an alleged ‘double collection route’ where both administrative collection by the TGR and civil lawsuits were being pursued for the same debt. The TGR has contested this, arguing that it is a mandatory legal sequence where the state guarantee is only activated after creditor banks exhaust civil litigation. The TGR clarified that out of 2,904 protection resources filed nationwide, it has won 1,028 cases, and in La Serena specifically, it has won 76 out of 84 cases. The institution has announced its intent to appeal the La Serena decision to the highest court. In a separate ruling on August 13, 2026, the Concepción Court of Appeals determined that CAE debts held with the Treasury do not expire or become void when the original bank promissory note reaches its statute of limitations. ~~The~~ This court ~~rejected a debtor’s attempt to halt coercive collection, ruling~~ ruled that once the state guarantee is exercised, a public debt is created in favor of the ~~TGR.
