Chile security legislation reforms

In late July 2026 the Chilean government introduced a short‑term bill to amend the Municipal Security Law, exempting salaries and allowances for municipal security personnel from the 42 % spending cap and allowing municipalities to obtain class‑F driver licences for patrol vehicles through agreements with traffic authorities.

A few days later the Chamber of Deputies approved a separate project expanding the presumption of privileged self‑defense to off‑duty members of the Armed Forces and public security forces, clarifying that they may use force to repel aggression that could cause serious injury or death.

On 4 August 2026 the Chamber approved another security‑related bill that would permit members of the Armed Forces deployed in areas under a constitutional state of exception to conduct identity checks, vehicle inspections and detain individuals caught committing crimes. The measure passed 119‑27 and was sent to the Senate. Supporters argue the temporary powers will improve response in rural zones such as La Araucanía and Tarapacá, while critics warn of possible constitutional and civil‑rights concerns.

Later that day Public Security Minister Martín Arrau presented additional proposals that would further broaden the powers of the armed forces and police. The package adds a fifth state of exception authorising targeted telecom interception in zones affected by organized crime or terrorism, and reiterates the identity‑check and detention provisions already approved. At the same time, Law No. 21.659 reforms the private security sector, shifting it to a risk‑management model with stricter state supervision and higher professional standards; the University of Chile will offer a postgraduate diploma to train specialists. Parties such as the UDI have voiced strong support, while civil‑rights groups continue to raise constitutional concerns.
